General Conditions of PIF Foundation and Play it Forward B.V.

1. Definitions

Agreement : every agreement between PIF BV and/or PIF Foundation on the one hand and the Nonprofit on the other hand, or between PIF BV and the User;

Nonprofit : the legal person that has signed, or intends to sign, the Sponsor Agreement and/or the Nonprofit Member;

Nonprofit Member : the legal person for which PIF BV has made a Nonprofit Page on the Website;

Nonprofit Page : the page on the Website on which information is presented to the visitors of the Website about the Nonprofit and where funds can be acquired for the Nonprofit;

General Conditions : general conditions of PIF Foundation and Play It Forward BV including the Special Provisions;

PIF: PIF Foundation and Play It Forward BV;

PIF BV : the private company with limited liability organised under Dutch law, Play It Forward B.V., registered with the Dutch Chamber of Commerce under number 34291870, having its registered office at Tolstraat 129, Unit A3.16 (1017 TT) in Amsterdam, the Netherlands;

PIF Foundation : the Foundation Play It Forward, organised under Dutch law and registered in the commercial register of the Dutch Chamber of Commerce under the name “Stichting PIF” under number 34291870, having its registered office at Tolstraat 129, Unit A3.16 (1017 TT) in Amsterdam, the Netherlands;

Player : the natural person who or legal person that has a personal account with PIF BV;

Privacy Statement : the Privacy Statement of PIF as can be found on the Website;

Project : the project that, on the basis of the Sponsor Agreement, has been placed on the Website by PIF BV; Project Budget: the total budget (irrespective the question whether or not the Nonprofit has already acquired part of this budget as a result of fundraising activities other than through the Website) that in the view of the Nonprofit is required to realise the Project;

Project Page : the page on the Website on which information is presented to the visitors of the Website about the Project;

Special Provisions : special provisions PIF – Player and/or special provisions PIF – Nonprofit;

Special Provisions PIF – Player : the special provisions that apply to the (legal) relation between PIF BV and the Player;

Special Provisions PIF – Nonprofit : the special provisions that apply to the legal relations between PIF BV and/or PIF Foundation on the one hand and the Nonprofit on the other hand;

Sponsor Agreement is the Agreement between PIF and the Nonprofit on the basis of which PIF BV places the Project on the Website and on the basis of which PIF Foundation is prepared to raise funds for the Project;

User : every natural person who or legal person that uses the Website, in whichever manner, including though not limited to the Player and the Nonprofit;

Wallet : the overview on the Website of the funds donated by a Player to PIF Foundation and through which such Player at a later moment can indicate (per unit of 5 Euro) which project or nonprofit should benefit from such funds;

Website : the website of PIF BV with Uniform Resource Locator (URL) http:// www.pifworld.com or any other URL indicated by PIF BV.

2. Applicability

2.1 By using the Website, in any way whatsoever, the User accepts to be legally bound to these General Conditions. These General Conditions furthermore apply to all applications, offers, assignments and agreements of PIF BV and/or PIF Foundation. General conditions of Users are specifically rejected.

2.2 PIF is entitled to amend these General Conditions at any time without notifying the User of this. It is the User's responsibility to stay updated on the changes made by PIF. The most recent version of the General Conditions will be available on the Website. If the User continues the use of the Website after one or more amendments to these General Conditions, this implies that the User irrevocably accepts this (these) amendment(s).

2.3 These General Conditions consist of:

• (i) a general part that applies to the (legal) relations between PIF Foundation and/or PIF BV and the User (article 2 to article 11); and
• (ii) a part that specifically and solely applies to the (legal) relations between PIF Foundation and/or PIF BV and the Nonprofit (the Special Conditions PIF-Nonprofit, articles 1.1 to 1.3); and
• (iii) a part that specifically applies to the (legal) relations between PIF Foundation and PIF BV and the Player (the Special conditions PIF - Player, article 1.1 to 1.11).

2.4 These General Conditions are drawn up in the Dutch and English language. In case either the content or the meaning are conflicting, the Dutch text shall prevail.

2.5 English language words used in these General Conditions intend to describe Dutch legal concepts only and the consequences of the use of those words in English law or any other foreign law shall be disregarded.

2.6 Deviations from these General Conditions are only binding if and in as far as they are confirmed in writing by PIF.

2.7 If one or more provision(s) of these General Conditions are nullified, declared void, or prove to be invalid, the remaining provisions will continue to apply in their original form.

3. Use of the Website

3.1 The User guarantees that (s)he is authorised to make use of the services offered by PIF and that (s)he will act in accordance with these General Conditions and, if applicable, the Special Conditions. The User furthermore guarantees that (s)he will at all times perform the obligations under these General Conditions and if applicable, the Special Conditions and that (s)he will observe all laws and regulations governing the use of the Website.

3.2 Without prejudice to the other provisions of these General Conditions, the actions and/or activities carried out by the User, relating to PIF and/or the Website may not:

• (a) infringe the rights of PIF BV, PIF Foundation and/or third parties, including intellectual property rights, such as (but not limited to) copyrights, database rights, neighbouring rights, trademark rights and patents, or rights relating to the protection of privacy;
• (b) infringe any law, regulation, bye-law or any other applicable regulation;
• (c) contain viruses, Trojan horses, worms, bots, or other programmes that may damage, harm, delete, or otherwise render inaccessible and/or useless any authorised work or data;
• (d) be based on lies and/or be misleading;
• (e) be of a commercial nature, unless PIF BV has given prior written approval; or
• (f) in any other manner be unlawful towards PIF BV, PIF Foundation and/or a third party.

3.3 Nothing in these General Conditions and/or on the Website is meant to transfer any intellectual property rights and/or grant any intellectual property rights to the User. The use the User may make of the Website is limited to what has been described in these General Conditions.

3.4 It is not permitted to remove, make illegible, hide, or change any notices or statements relating to intellectual property rights.

4. Uploading files

4.1 Under the conditions provided in these General Conditions and the Special Conditions, the User in principle keeps the copyrights and other intellectual property rights (s)he owns with regard to files (s)he makes available via the Website to the visitors of the Website.

4.2 The User acknowledges and agrees that by making files, data and/or materials available to PIF BV (in these General Condition this refers among others to the uploading of them), the User automatically grants PIF BV:

• (i) a royalty free, unencumbered, worldwide, non-exclusive license, to
• (a) use, reproduce, distribute and publicise the files, data and/or materials, in connection with the service of PIF; and
• (b) use, reproduce (and to allow third parties to use and reproduce) the files, data and/or materials, via any medium, for marketing and/or promotional purposes in connection with the service of PIF;
• (ii) the right to remove intentionally or unintentionally and for whatever reason and also without any reason being given from the PIF servers and from the Website any files, data and/or materials, made available by the User, without PIF becoming liable to the User or a third party in any way whatsoever as a result of such a removal.

4.3 The User acknowledges and agrees that the files, data and/or materials that (s)he has made available to PIF BV will be used by other Users of the Website. PIF does not accept any liability for the compliance with these General Conditions by the users of the Website. The User therefore acknowledges that the possibility exists that the files, data and/or materials made available by him/her to PIF BV are used by third parties in a manner that is contrary to these General Conditions or any legal provision or other unlawful act of third parties in relation to the files, data and/or material made available by the User.

4.4 The User guarantees that (s)he is fully entitled with regard to the files, data and/or materials as meant in article 4.2 and that (s)he is fully entitled and authorised to grant the license as meant in these General Conditions. The User indemnifies PIF and all affiliated companies and persons, against any claims by third parties based on the allegation that the files, data and/or materials infringe any current (intellectual property) right of third parties or are otherwise unlawful towards third parties and against all claims resulting from him/her acting contrary to these General Conditions. All costs incurred and damages suffered by PIF that any way shall be at the expense of the User.

4.5 The User is not allowed to make available via the Website files, data and/or materials (it being at the sole assessment of PIF BV):

• (a) that ask personal data of minors; and/or
• (b) that make personal data available; and/or
• (c) that ask for passwords or other information that can be traced to persons for commercial or illegal purposes; and/or
• (d) that are discriminatory as to appearance, race, religion, gender, culture, origin or may otherwise be called offensive; and/or
• (e) that incite to violence against and/or harassment of another person or other persons; and/or
• (f) that may lead to, or are the result of, exploitation or abuse of others; and/or
• (g) that, in the reasonable judgement of PIF BV, are contrary to public morality or good taste, are violent or contain a link to pornographic material or pornographic websites or include pornographic or erotic material; and/or
• (h) that involve commercial activities without prior written approval of PIF BV, such as advertising lotteries, contests or pyramid games; and/or
• (i) that encourage or commits the performance of illegal activities; and/or
• (j) that involve chain letters, junk-mail or spamming; and/or
• (k) that include a photograph or image of another person without that person's consent; and/or
• (l) that infringe intellectual property rights of others; and/or
• (m) that infringe any law, regulation, bye-law or other applicable regulations, or these General Conditions.

5. Content of Third Parties

5.1 It is possible that the Website contains applications, files, data and/or materials and services of third parties and/or links to websites of third parties ("Content of Third Parties") for example by means of a hyperlink, banner or button. The inclusion or availability of Content of Third Parties on the Website does not imply that PIF has approved and/or checked this Content of Third Parties. PIF is not responsible for the content or manner of operation of Content of Third Parties or for any use thereof by the Users of the Website.

5.2 For products or services offered by third parties, the applicable terms and conditions of those third parties apply.

6. PIF's services

6.1 PIF does not regulate the communication between Charities, Players and Users among themselves and/or Users and the service of PIF. PIF has no, or at most very limited control over the quality, safety, lawfulness, integrity or accuracy of the various parts of PIF's services.

7. Privacy

By using the Website the User is bound by the Privacy Statement.

8. Discontinuation of services

8.1 In addition to the other (legal) remedies that are at the disposal of PIF, PIF BV is entitled to restrict the activities of the User in connection to the Website, to discontinue and/or remove the account of a User to remove files, data and/or materials, to inform the other Users of the Website of the activities, to send out a warning and refuse to provide services to the User, particularly but not limited to, in the event:

• - the User acts in violation with these General Conditions and/or in violation with the Special Conditions;
• - PIF BV and/or PIF Foundation are not capable to verify or identify certain data that the User provides to PIF BV and/or PIF Foundation;
• - PIF BV is of the opinion that the actions of the User may harm him/herself, other Users, or PIF;
• - PIF BV is of the opinion that the actions of the User may result in liability for him/herself, for other Users, or for PIF.

PIF will not have any liability whatsoever in this respect.

8.2 PIF BV is entitled without prior notification and without justification, to temporarily or permanently render the service unavailable or to limit the use thereof or to terminate the services all together and this will not result in any right for damages towards PIF.

8.3 PIF does not guarantee that the service of PIF BV will be available at all times, without interruptions or breakdowns.

9. Donations

9.1 Users can donate funds for the benefit of a Project or a Nonprofit to PIF Foundation or to a Nonprofit.

Payment of the funds donated to PIF Foundation for the benefit of a Project

9.2 After reaching the Project Budget and under the conditions mentioned in the Sponsor Agreement, PIF Foundation shall transfer the donations, minus transaction costs, to the Nonprofit for the Project it manages or supports.

9.3 PIF BV reserves the right not to place the Project on the Website or to temporarily, or permanently remove the Project from the Website if:

• (a) the Project Budget has not been reached within six months starting from the moment the Project is placed in the Website; and/or
• (b) the Nonprofit is acting in a manner conflicting with the General Conditions; and/or
• (c) facts or circumstances are revealed with regard to the Project and/or the Nonprofit which, would PIF have been aware of such facts or circumstances at the time of entering into the Agreement, could have led to a reason for PIF not to enter into the Agreement; and/or
• (d) the Nonprofit does not fulfil the obligations as laid out in the Sponsor Agreement regarding the provision of visual reports (video or photo) about the Project.

9.4 PIF BV will inform the Nonprofit via e-mail regarding its decision not to place the Project on the Website or to (temporarily or permanently) remove the Project from the Website.

9.5 In case the Project is (temporarily or permanently) removed from the Website, the Nonprofit is neither entitled to the funds that have been acquired by PIF Foundation for the Project, nor to any compensation or damages.

9.6 In the case of removal of the Project from the Website pursuant to article 9.3 and provided PIF Foundation has not (yet) transferred funds to the Nonprofit, the Wallet of the Players who donated on behalf of the Project will be credited with the same amount in order to enable such Players to support other project(s) on the Website with such amount, provided such Players had an account with the Website at the time of such donation.

9.7 Users and/or Players who donated on behalf of a Project without having an account with the Website at the time of such donation will, in case of removal of the Project from the Website, not be entitled to repayment of the amount donated on behalf of such Project. In that case PIF Foundation shall, at its discretion, allocate the funds it received in relation to the Project to an Nonprofit which has a project on the Website.

9.8 In the event PIF Foundation has already transferred the funds or part of the funds to the Nonprofit, crediting of the Wallet as referred to in Article p 9.6 will not take place. In that case PIF Foundation shall, at its discretion, allocate the funds it received in relation to the Project to an Nonprofit which has a project on the Website.

9.9 In the event two Users donate the missing amount to complete the project budget of a Project at the same time, the situation may occur that all these donations will be processed. If the User who donated last is a Player, his/her donation will be returned to his/her Wallet. If the User who donated is not a Player, he/she will not be entitled to repayment of the amount donated on behalf of such Project. In that case PIF Foundation shall, at its discretion, allocate the funds it received in relation to the Project to an Nonprofit which has a project on the Website.

9.10 Articles 175 to 188 of Book 7 of the Dutch Civil Code regarding donations (in Dutch ‘schenking’) apply to the legal relations between PIF Foundation and the User(s).

9.11 In accordance with Article 7:175, subsection 2 of the Dutch Civil Code, a donation made by a User to PIF Foundation counts as accepted, when PIF Foundation, after acknowledgement of the donation, has not rejected this donation to the suspension of all other business.

9.12 The deposited donations cannot be reclaimed, in accordance with article 46a to f of book 7 of the Dutch Civil Code, department 9A: Agreements from a distance (in Dutch "Overeenkomsten op afstand").

Payment of the funds donated to a Nonprofit and/or to PIF Foundation for the benefit of a Nonprofit

9.13 Funds donated by a User to a Nonprofit other then through allocation of the funds in the Wallet of such User to that Nonprofit are gifts to the Nonprofit and are directly transferred by the User to the bank account of the Nonprofit in the Netherlands provided by the Nonprofit to PIF BV.

9.14 Articles 175 to 188 of Book 7 of the Dutch Civil Code regarding donations (in Dutch ‘schenking’) apply to the legal relations between the Nonprofit and the User(s).

9.15 In accordance with Article 7:175, subsection 2 of the Dutch Civil Code, a donation made by a User to the Nonprofit counts as accepted, when the Nonprofit, after acknowledgement of the donation, has not rejected this donation to the suspension of all other business.

9.16 The deposited donations cannot be reclaimed, in accordance with article 46a to f of book 7 of the Dutch Civil Code, department 9A: Agreements from a distance (in Dutch "Overeenkomsten op afstand").

9.17 Funds donated by a User to a Nonprofit through allocation of the funds in the Wallet of such User to that Nonprofit will be transferred by PIF Foundation to the Nonprofit once per quarter of the year to the bank account of the Nonprofit in the Netherlands provided by the Nonprofit to PIF BV.

9.18 PIF BV reserves the right not to place the Nonprofit on the Website or to temporarily, or permanently remove the Chariy from the Website if:

• (a) the Nonprofit is acting in a manner conflicting with the General Conditions; and/or
• (c) facts or circumstances are revealed with regard to the the Nonprofit which, would PIF have been aware of such facts or circumstances at the time of making a Nonprofit Page for that Nonprofit, could have led to a reason for PIF not to make a Nonprofit Page for that Nonprofit.

9.19 PIF BV will inform the Nonprofit via e-mail regarding its decision not to place the Nonprofit on the Website or to (temporarily or permanently) remove the Nonprofit from the Website.

9.20 In case the Nonprofit is (temporarily or permanently) removed from the Website, the Nonprofit is neither entitled to the funds that have been acquired by PIF Foundation for the Nonprofit, nor to any compensation or damages.

9.21 Articles 175 to 188 of Book 7 of the Dutch Civil Code regarding donations (in Dutch ‘schenking’) apply to the legal relations between PIF Foundation and the User(s).

9.22 In accordance with Article 7:175, subsection 2 of the Dutch Civil Code, a donation made by a User to PIF Foundation counts as accepted, when PIF Foundation, after acknowledgement of the donation, has not rejected this donation to the suspension of all other business.

10. Liability

10.1 Neither PIF BV, nor PIF Foundation can be held liable in any way whatsoever for the implementation, financing, budgeting, spending of money donated for the Project and/or the Charities, monitoring, evaluation and follow-up of Projects and/or Charities.

10.2 To the extent permitted by law, PIF (which in this case includes companies, officials and employees related to PIF) hereby excludes any liability for any type of damage, direct and/or indirect, which in any manner originated from and/or resulted from the use of the Website or another site which is linked to the Website.

10.3 Without prejudice to the foregoing, PIF more specifically shall not be liable for whichever damages, that are in any manner caused by and/or a result of:

• - actions carried out by the User, that would have been inspired by the information placed on the Website; and/or
• - the inability to use the Website; and/or
• - the fact that certain information on the Website is incorrect, incomplete or not up to date; and/or
• - the manner in which Nonprofits, Players or other Users make use of the services and/or equipment and similar provisions offered by PIF. Nonprofits, Players or other Users shall specifically indemnify PIF against claims by third parties, that relate to the content of the files, data and or materials supplied by them which PIF makes available on the Website.

10.4 In case PIF, as a result of a shortcoming for which PIF is accountable, is nevertheless liable, the liability will at all times be limited to the direct property damage that are in direct connection to the shortcoming. In any case, PIF will never be liable for consequential damage, including but not limited to pure financial loss, loss of turnover and profit, loss of data and immaterial damage, resulting form or in connection with the services rendered by PIF and/or the use of the Website.

10.5 Insofar PIF, as a result of a shortcoming for which PIF is accountable, is nevertheless liable, this liability will at all times be limited per event (whereby a series of related events will be regarded as one single event) to the donated money that has actually been donated by the User to PIF Foundation in the current calendar year.

10.6 This restriction of liability does however not mean that PIF excludes any liability for intent and/or gross negligence on the part of PIF itself and/or the PIF board.

11 Other provisions; applicable law

11.1 Without prejudice to any existing statutory obligations on the part of PIF to retain the agreement between a User and PIF in connection with the use of the Website, PIF does not have to keep any archived agreement accessible of this User.

11.2 These General Conditions shall be governed by and construed in accordance with the laws of the Netherlands. Any dispute resulting from or arising in connection with these General Conditions shall be exclusively submitted to the competent courts in Amsterdam, the Netherlands.

SPECIAL CONDITIONS PIF - Nonprofit

1. Project application and Project selection

1.1 Foundations organised under Dutch law with a bank account in the Netherlands can apply with PIF BV for placement of a Project on the Website by sending a completed Application form, as mentioned on the Website. Application forms completed by comparable foreign entities may also be taken into consideration.

1.2 The items specified in the Project Budget should refer to costs that are directly linked to the implementation of the Project.

1.3 PIF BV decides whether a Project is placed on its Website, and this decision depends among others on:

• a. the manner/measure in which the project contributes to a positive change for man, animal, or planet;
• b. the manner/measure in which the foundation referred to in article 1.1. at that moment fulfils and/or in the past has fulfilled its obligations under the Sponsor Agreement and the General Conditions and Special Conditions.
• c. the offer of Projects on the Website taking into account an equally distributed project portfolio.

2. Application as Nonprofit Member

2.1 Foundations organised under Dutch law with an ANBI-status and a bank account in the Netherlands can apply with PIF BV as Nonprofit Member by sending a completed Application form (including attachments a recent extract of the Chamber of Commerce and a copy of the memorandum of association) as mentioned on the Website. Application forms completed by comparable foreign entities may also be taken into consideration.

2.2 PIF BV decides whether a Nonprofit is accepted as a Nonprofit Member, and this decision depends among others on:

• a. the manner/measure in which the Nonprofit contributes to a positive change for man, animal, or planet;
• b. the manner/measure in which the Nonprofit referred to in article 1.1. at that moment fulfils and/or in the past has fulfilled its obligations under the General Conditions and Special Conditions.

2.3 At the request of PIF BV the Nonprofit shall provide PIF BV with the financial statements of the current or previous financial year.

SPECIAL CONDITIONS PIF - Player

1. Account

1.1 A User can apply for his/her own account in the manner described on the Website in order to be able to make use of certain service(s) of PIF.

1.2 PIF BV may at its own discretion decide whether or not to provide a User with an account.

1.3 Legal entities with a for profit character which have created an account on the Website (and thus have become a Player) can only become and remain Player on the Website and (therefore) create and maintain a profile with the prior written consent of PIF BV. Unless explicitly agreed otherwise, this consent terminates on the moment the Website contains a separate functionality that is (also) designed for such legal entities. PIF BV is also entitled to withdraw its consent at any time or impose conditions for such consent.

1.4 The Player can terminate his/her account at any required time in the manner as described on the Website. The Player will not be entitled to repayment of any amount in the Wallet at the time of termination of his/her account. PIF Foundation shall, at its discretion, allocate these funds to an Nonprofit which has a project on the Website.

1.5 The Player guarantees to PIF that the information provided by the Player to PIF is complete, truthful and accurate, including the personal details of the Player such as his/her name and e-mail address.

1.6 The Player agrees that PIF BV uses and saves the details/data and use them in connection with the management of the account.

1.7 If the Player is younger than sixteen (16) years of age, (s)he should obtain the consent of his/her parents or guardian to create an account. By accepting these General Conditions, the Players guarantees that (s)he is either over sixteen (16) years of age, or has the consent of his/her parents or guardian to create an account.

1.8 The Player is not allowed to create an account in the name of another person, unless that other person has granted him/her (written) consent to do so and the Player will hand over this written permission to PIF BV upon first request from PIF BV.

1.9 In the event a Player, when (s)he created his/her account, has chosen a username which forms part of the name of a current or future partner of PIF, the username of such Player will be changed into "Player[Username]".

1.10 The Player is personally responsible for keeping the password of his/her account confidential to others and shall not grant others access to the services of PIF by using his/her account.

1.11 In the period prior to the moment the Player notifies PIF of any unauthorised use, the Player is liable for the consequences of the fact that other(s) use the account of the Player, with or without his/her consent or knowledge.

Privacy Statement of Play it Forward B.V.

Play it Forward B.V. (hereafter 'PIF') takes your privacy very seriously. PIF adheres to the following principles to protect your privacy:

• (i) PIF will never pass your contact information on to anyone, including the partner organization whose project you have chosen to support, without your express consent; and
• (ii) PIF does not rent or sell your personally identifiable information to third parties for marketing purposes; and
• (iii) any personally identifiable information that you provide will be secured with industry standard protocols and technology.

Who is Play it Forward B.V.?

PIF is the creator of Pifworld.

PIF, established in 2007, is a private limited liability company organized under Dutch law, with registered office in Amsterdam, the Netherlands. PIF is having its office at Tolstraat 129 -A3.16, Amsterdam and is registered at the Dutch Chamber of Commerce under number 34291870. The manner in which your personal details are saved and used has been reported to the Dutch Data Protection Authority under number m1394590. PIF can be reached via

What personally identifiable information of yours is collected and processed by PIF?

PIF collects your personal information in the following ways:

(i) information PIF collects from you as a Website visitor

PIF collects information about your Internet Protocol (IP) addresses, the URL's of sites from which you arrive or leave the Website, your type of browser and your ISP. An IP address is a number assigned to your computer automatically when you use the internet making it possible to recognize your computer. This information helps PIF to monitor site traffic patterns in order to improve its service and to assess from which computers the Website is visited in case of potential abuse such as hack attempts. This data can also be used to reveal the identity of potential stalkers if PIF and/or the Website is being molested or in case of fake accounts.

The linkage between your IP address and your personally identifiable information is not shared with third-parties without your permission or except when required by law.

Like many Websites, PIF uses cookies and web log files to track site usage to recognize you, customize your experience on the Website and serve advertisements. (ii) information PIF collects from your registration as a Player or from your Profile

In order to become a Player, you must first create an account on Pifworld. When creating such account, you have to complete the following information about yourself: e-mail address, username and password. You can always adjust the information you have provided with the exception of your username.

Once you are a Player, you may provide additional information on your profile or when making a donation. Providing additional information beyond what is required at registration is entirely optional. You can indicate what your interests are, what countries you like etceteras as part of your profile. This is useful for other Players who are viewing your profile but also for PIF because in this way PIF will be better able to adjust Pifworld to your wishes.

Any information you provide at registration as a Player or in your Profile or when making a donation that is not personally identifiable may be used in the same manner and extent to which other information that is not personally identifiable is permitted to be used hereunder, including for the purpose of serving advertisements through the Website.

(iii) information PIF collects when you donate without registration as a Player

When you donate without registration as a Player, you have to complete the following information about yourself: your first name and last name, city of residence, country of residence and e-mail address. You can provide extra information when making a donation (by placing a donation comment).

(iv) information PIF's payment service provider collects from you when you donate or upload your Wallet

If you donate or upload your Wallet on the Website, payment details (such as your credit or debit card details) are requested. Please note that these payment details will not be collected by PIF but by its payment service provider RBS WorldPay which processes your donation. Consequently your credit or debit card details will not be known by PIF.

For what purposes will PIF use information about you?

PIF will use information about you for the specific purposes as set out above and for the following general purposes:

• (i) to communicate with you about Pifworld and to send information to you about Pifworld's services such as Pifworld updates;
• (ii) to adjust Pifworld to your wishes and needs
• (iii) for security purposes; and
• (iv) to formulate rendered anonymous statistical data; PIF may provide automatically generated data, including your IP-address, to third parties that draw up user statistics for PIF and that perform web analyses.

Communications from PIF

PIF will communicate with you through email and notices posted on the Website. As a Player you may receive periodically an update by email from PIF about Pifworld. If you donate without registration, you will not receive such updates and will only receive emails from PIF if you have indicated you wish to receive these. Every mail to donors without registration, will contain the possibility to unsubscribe. As a Player you can opt out for the periodic update in your profile.

PIF will occasionally send you email about Pifworld in general as well as notifications about any important changes in the service provided.

Communications with/from other Players within Pifworld

In order to invite others to become Friends with you within Pifworld, you may use the Pifworld services to invite them if they are Players, or enter their names and email addresses. This information will be used by PIF to send your invitation including a message that you write. The names and email addresses of people that you invite will be used only to send your invitation and reminders. When you provide a friend's email address for PIF to forward a web address PIF will only use your friend's address for this purpose.

As a Player you may receive emails from other Players who wish to become Friends with you. You may also receive per mail a request from befriended Player to donate on their supported project or receive private messages from Friends.

Blogs

If you write a blog within Pifworld you should be aware that any personally identifiable information you choose to provide there can be read, collected, or used by third parties, and could be used to send you unsolicited messages. PIF is not responsible for the personally identifiable information you choose to submit in such blogs.

What personally identifiable information of yours is visible to others?

If registered as a Player, other visitors of the Website can see your username and country of residence and your full profile (so if you have provided extra information in your profile, or during a donation, this will also be visible). If you have donated without registering as a Player, visitors can see your name, city, country of residence, the amount of your donation and, if placed, your donation comment.

Please note that your profile may be indexed in search engines. Furthermore, other Players and visitors can see a list of your Friends, the projects you donated to and the (accumulated) amount of your donations as well as the donation comment if placed. Should you wish that the amount of your donations remain invisible to others you can, as a Player, indicate this in your profile and consequently the accumulated amount of your donations will not be shown in your public profile nor be visible on the Project Page of the project you donated to. With regard to donors who have not registered as a Player the amount that is transferred per donation will always be visible on the Project Page.

Information Sharing and Disclosure

In order to deliver its services, PIF engages certain trusted third parties to perform functions and provide services, including, without limitation, hosting and maintenance, database storage and management and payment services. PIF will share your personally identifiable information with these third parties, but only to the extent necessary to perform these functions and provide such services.

PIF may also disclose your personal and other information you provide, to another third party in connection with a merger, acquisition, reorganization, sale of assets or in the event of bankruptcy . Any third party to which PIF transfers or sells its assets will have the right to continue to use the personal and other information that you provide to PIF.

Security precautions to protect your information

In order to secure your personal data, access to your data on the Website is password-protected. The applicable data (such as your credit card information) is protected by encryption using Secure Sockets Layer protocol. It is your responsibility to protect the security of your login information. Please note that emails with other Players within Pifworld are not encrypted and PIF strongly requests you not to communicate any confidential information through these means.

Children and Pifworld

In principle everybody can join Pifworld and everybody can create an account on Pifworld. However, it is important that special legal rules apply to persons who are not yet sixteen (16). If you are not yet sixteen (16) you are required to obtain the consent of your parents or guardian before you create an account on the Website. By accepting this Privacy Statement you guarantee that you are at least sixteen (16) years of age or have the consent of your parents/guardian to create an account.

Transfer of data to countries outside the EU

For technical and operational reasons it may be necessary that your (personal) details are transferred to (servers of) companies affiliated to PIF and/or advertisers in the United States or other countries outside Europe where the regulations in the field of privacy protection might not provide the same protection as in the European Union. Insofar as this is necessary, you hereby agree that your (personal) details can be transferred to the United States or other countries outside Europe.

Examination and improvement of your own details

You can always view your own (personal) details and if necessary change or delete them in your Profile, provided you cannot delete the required fields for registration.

You can also close your account through the Pifworld Website in your Profile. If you close your Pifworld account, PIF will remove your name and other personally identifiable information from our publicly viewable data. PIF may retain certain data contributed by you if it may be necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally-identifiable data, account recovery, or if required by law. All retained data will continue to be subject to the terms of the PIF Privacy Statement in effect at the time of your request.

The Website contains links to other Websites such as the Websites of the partner organizations that carry out the projects you wish to play forward. PIF has no power over the Websites of third parties to which you are linked. Other sites follow different rules regarding the use or disclosure of the personally identifiable information you submit to them. PIF encourages you to read the privacy policies or statements of the other Websites you visit. This Privacy Statement only relates to (personal) details which have been obtained via the Website. PIF does not accept any responsibility or liability for (the operation and/or contents of) Websites of third parties.

Compliance with Laws and Law Enforcement

Although unlikely, PIF may be forced by law to provide personally identifiable information to the appropriate authorities. Algemene Voorwaarden van Stichting PIF en Play it Forward B.V.

1. Begripsbepalingen

Algemene Voorwaarden: algemene voorwaarden van Stichting PIF en Play It Forward B.V. inclusief de Bijzondere Bepalingen;

Bijzondere Bepalingen: Bijzondere Bepalingen PIF – Player en/of Bijzondere Bepalingen PIF – Nonprofit;

Bijzondere Bepalingen PIF – Player: de bijzondere bepalingen die van toepassing zijn op de rechtsverhouding tussen Play It Forward B.V en de Player;

Bijzondere Bepalingen PIF – Nonprofit: de bijzondere bepalingen die van toepassing zijn op de rechtsverhouding tussen Play It Forward B.V. en/of Stichting PIF enerzijds en de Nonprofit anderzijds;

Gebruiker: iedere natuurlijke persoon of rechtspersoon die gebruik maakt van de Website, op welke manier dan ook, waaronder begrepen doch niet beperkt de Player en de Nonprofit;

Nonprofit: de rechtspersoon die met PIF een Sponsor- en Plaatsingsovereenkomst heeft gesloten of wenst te sluiten en/of de Nonprofit Member;

Nonprofit Member: de rechtspersoon waarvoor door PIF BV op de Website een Nonprofitpagina is aangemaakt;

Nonprofitpagina: de pagina op de Website waar informatie aan de Gebruikers wordt verschaft over de Nonprofit en waar gelden kunnen worden geworven voor de Nonprofit;

Overeenkomst: iedere overeenkomst tussen PIF BV en/of Stichting PIF enerzijds en de Nonprofit anderzijds dan wel tussen PIF BV en de Gebruiker;

PIF: Stichting PIF en Play It Forward B.V.;

PIF BV: de besloten vennootschap met beperkte aansprakelijkheid Play It Forward. B.V. , in het handelsregister bij de Kamer van Koophandel ingeschreven onder nummer 34291870, kantoorhoudende te Amsterdam aan (1074 VJ) de Tolstraat 129 unit A3.16, en statutair gevestigd te Amsterdam;

Player: de natuurlijke persoon of rechtspersoon die een eigen account heeft bij PIF BV;

Privacy Verklaring: de Privacy Verklaring van PIF zoals opgenomen op de Website;

Project: het project dat op grond van de Sponsor-en Plaatsingsovereenkomst door PIF BV op de Website is geplaatst;

Project Budget: is het totale budget (onafhankelijk van de vraag of de Nonprofit reeds in een deel van dit budget heeft voorzien anders dan met behulp van de Website) dat naar het oordeel van de Nonprofit nodig is om het Project te kunnen realiseren;

Projectpagina: is de pagina op de Website waar informatie aan de Gebruikers wordt verschaft over het Project;

Sponsor- en Plaatsingsovereenkomst: de overeenkomst tussen PIF en de Nonprofit op grond waarvan PIF BV het Project op de Website plaatst en op grond waarvan Stichting PIF bereid is gelden te werven voor het Project;

Stichting PIF: de Stichting Play It Forward, in het handelsregister bij de Kamer van Koophandel ingeschreven onder de naam Stichting PIF onder nummer 34298844, kantoorhoudende te Amsterdam aan (1074 VJ) Tolstraat 129, unit A3.16 en statutair gevestigd te Amsterdam;

Wallet: is het overzicht op de Website van gelden geschonken door een Player aan Stichting PIF waarbij de desbetreffende Player op een later tijdstip per eenheid van 5 Euro kenbaar kan maken aan welk Project of aan welke Nonprofit deze gelden ten goede dienen te komen;

Website: de website van PIF BV met Uniform Resource Locator (URL) http://www.pifworld.com of ieder andere door PIF BV aan te wijzen URL.

2. Toepasselijkheid

2.1 Door gebruik te maken van de Website, op welke wijze dan ook, aanvaardt de Gebruiker gebonden te zijn aan deze Algemene Voorwaarden. Daarnaast zijn deze Algemene Voorwaarden van toepassing op alle aanvragen, offertes, opdrachten en overeenkomsten van PIF BV en/of Stichting PIF. Andere (algemene) voorwaarden van Gebruikers worden uitdrukkelijk van de hand gewezen.

2.2 PIF heeft het recht deze Algemene Voorwaarden zonder kennisgeving aan de Gebruiker op elk gewenst moment aan te passen. De Gebruiker heeft de verantwoordelijkheid deze Algemene Voorwaarden regelmatig te raadplegen, teneinde ervoor te zorgen dat hij/zij bekend is met alle door PIF aangebrachte wijzigingen. De meest actuele versie van de Algemene Voorwaarden zal zijn te raadplegen op de Website. Indien de Gebruiker het gebruik van de Website voortzet na een of meer wijzigingen van de Algemene Voorwaarden impliceert dit dat hij/zij deze wijziging(en) onvoorwaardelijk en onherroepelijk aanvaardt.

2.3 Deze Algemene Voorwaarden bestaan uit:

• (i) een algemeen gedeelte dat van toepassing is op de (rechts-)betrekkingen tussen Stichting PIF en/of PIF BV en de Gebruiker (artikel 2 tot en met artikel 11); en
• (ii) een gedeelte dat uitsluitend van toepassing is op de (rechts-)betrekkingen tussen Stichting PIF en/of PIF BV en de Nonprofit (de Bijzondere bepalingen PIF – Nonprofit, artikelen 1.1 tot en met 1.3); en
• (iii) een gedeelte dat uitsluitend van toepassing is op de
• (rechts-)betrekkingen tussen Stichting PIF en PIF BV en de Player (de Bijzondere bepalingen PIF – Player, artikel 1.1. tot en met 1.11).

2.4 Deze Algemene Voorwaarden zijn in de Nederlandse en Engelse taal gesteld. Ingeval van geschil over inhoud of strekking van deze Algemene Voorwaarden, zal de Nederlandse tekst bindend zijn.

2.5 Afwijkingen van deze Algemene Voorwaarden zijn slechts verbindend indien en voor zover zij door PIF schriftelijk zijn bevestigd.

2.6 Indien een of meer bepalingen van deze Algemene Voorwaarden nietig is/zijn of vernietigd wordt/worden, blijven de overige bepalingen onverminderd van kracht.

3. Gebruik van de Website

3.1 De Gebruiker garandeert dat hij/zij bevoegd is om gebruik te maken van de diensten van PIF en zal handelen in overeenstemming met de Algemene Voorwaarden en, indien van toepassing, de Bijzondere Bepalingen. Daarnaast garandeert de Gebruiker dat hij/zij te allen tijde de verplichtingen uit hoofde van de Algemene Voorwaarden en, indien van toepassing, van de Bijzondere Bepalingen zal nakomen en dat hij/zij zich zal houden aan alle wetten en regelgeving die van toepassing zijn op het gebruik van de Website.

3.2 Niettegenstaande de overige bepalingen van deze Algemene Voorwaarden, mogen de handelingen en/of activiteiten die de Gebruiker verricht in het kader van PIF en/of de Website:

• (a) geen inbreuk maken op rechten van PIF BV, Stichting PIF en/of derden, waaronder intellectuele eigendomsrechten zoals, maar niet beperkt tot, auteursrechten, databankrechten, naburige rechten, merkrechten en octrooien of rechten met betrekking tot de bescherming van privacy;
• (b) niet in strijd zijn met enige wet, regeling, verordening of andere toepasselijke regelgeving;
• (c) geen virussen bevatten, Trojaanse paarden, wormen, bots of andere programmatuur die een geautomatiseerd werk of gegevens kan beschadigen, onbruikbaar of ontoegankelijk maken, wissen of zich toe-eigenen;
• (d) niet op onwaarheden zijn gebaseerd of misleidend zijn;
• (e) een commercieel karakter hebben, tenzij PIF BV hiervoor schriftelijk toestemming heeft gegeven; of
• (f) op enigerlei wijze anderszins onrechtmatig zijn jegens PIF BV, Stichting PIF en/of een derde.

3.3 Niets van wat in deze Algemene Voorwaarden en/of op de Website wordt vermeld, is bedoeld om enige intellectuele eigendomsrechten over te dragen en/of enige intellectuele eigendomsrechten aan de Gebruiker te verlenen. Het gebruik dat de Gebruiker mag maken van de Website is beperkt tot hetgeen in deze Algemene Voorwaarden is beschreven.

3.4 Het is niet toegestaan om kennisgevingen of vermeldingen met betrekking tot intellectuele eigendomsrechten te verwijderen, onleesbaar te maken, te verbergen of te wijzigen.

4. Bestanden uploaden

4.1 Onder toepassing van de Algemene Voorwaarden en de Bijzondere Bepalingen, behoudt de Gebruiker in beginsel de auteursrechten en andere intellectuele eigendomsrechten die aan de Gebruiker toebehoren met betrekking tot de bestanden die door de Gebruiker via de Website ter beschikking worden gesteld aan bezoekers van de Website.

4.2 De Gebruiker erkent en stemt ermee in dat door het beschikbaar stellen van bestanden, gegevens en/of materialen aan PIF BV (waarmee in deze bepalingen onder meer wordt bedoeld het uploaden daarvan), de Gebruiker automatisch aan PIF BV:

• (i) een kosteloze, onbezwaarde, wereldwijde, niet-exclusieve licentie verleent om
• (a) de bestanden, gegevens en/of materialen te gebruiken, te verveelvoudigen, te verspreiden en openbaar te maken in verband met de dienst van PIF; en
• (b) de bestanden, de gegevens en/of materialen te gebruiken en te verveelvoudigen (en aan derden toe te staan om te gebruiken te verveelvoudigen) in welke media dan ook voor marketing en/of promotiedoeleinden in verband met de dienstverlening van PIF;
• (ii) het recht om enige door de Gebruiker ter beschikking gestelde bestanden, gegevens en/of materialen te verwijderen van de servers van de Website, bedoeld of onbedoeld, en voor welke reden dan ook en ook zonder reden, zonder dat PIF op welke wijze dan ook aansprakelijk wordt jegens de Gebruiker of jegens een derde als gevolg van een dergelijke verwijdering.

4.3 De Gebruiker erkent en stemt ermee in dat de bestanden, gegevens en/of materialen die hij/zij ter beschikking stelt aan PIF BV gebruikt zullen worden door andere gebruikers van de Website. PIF is niet aansprakelijk voor naleving van deze Algemene Voorwaarden door gebruikers van de Website. De Gebruiker erkent dan ook dat de mogelijkheid aanwezig is dat de bestanden, gegevens en/of materialen die hij/zij beschikbaar stelt aan PIF BV door derden gebruikt worden op een manier die in strijd is met of niet voorzien is in deze Algemene Voorwaarden. PIF is niet aansprakelijk voor enige handelingen van derden in strijd met deze Algemene Voorwaarden of enige wetsbepaling of voor enig ander onrechtmatig handelen van derden ten aanzien van door de Gebruiker beschikbaar gestelde bestanden, gegevens en/of materialen.

4.4 De Gebruiker staat er jegens PIF voor in dat hij/zij volledig rechthebbende is ten aanzien van de bestanden, gegevens en/of materialen als bedoeld in artikel 4.2 en dat hij/zij volledig gerechtigd en bevoegd is om de licentie als bedoeld in deze Algemene Voorwaarden te verlenen. De Gebruiker vrijwaart PIF en alle aan haar gelieerde bedrijven en personen tegen alle aanspraken van derden die gebaseerd zijn op de bewering dat de bestanden, gegevens en/of materialen inbreuk maken op enig geldend (intellectueel eigendoms-) recht van derden of anderszins onrechtmatig zijn jegens derden en voor alle aanspraken die voortvloeien uit zijn/haar handelen in strijd met deze Algemene Voorwaarden. Alle door PIF gemaakte kosten en geleden schade op enige wijze verband houdende met dergelijke aanspraken zullen door de Gebruiker worden vergoed.

4.5 Het is de Gebruiker niet toegestaan bestanden, gegevens en/of materialen ter beschikking te stellen via de Website (waarbij een en ander ter uitsluitende beoordeling is van PIF BV):

• (a) waarbij persoonlijke gegevens worden opgevraagd van minderjarigen; en/of
• (b) waarbij persoonlijke gegevens ter beschikking worden gesteld; en/of
• (c) waarbij wachtwoorden of andere tot personen herleidbare informatie worden opgevraagd voor commerciële of illegale doeleinden; en/of
• (d) die discriminerend zijn wat betreft uiterlijk, ras, religie, geslacht, cultuur, afkomst of anderszins kwetsend genoemd mag worden; en/of
• (e) die oproepen tot geweld tegen en/of lastigvallen van een ander of anderen; en/of
• (f) die leiden tot of het gevolg zijn van uitbuiting of misbruik maken van anderen; en/of
• (g) die, zulks ter beoordeling van PIF BV, in strijd zijn met de goede zeden of goede smaak, gewelddadig zijn of een link bevatten naar pornografisch materiaal of pornografische website, of pornografisch of erotisch materiaal bevatten; en/of
• (h) waarbij commerciële activiteiten zijn gemoeid zonder voorafgaande schriftelijke toestemming van PIF BV, zoals advertenties, loterijen, wedstrijden of piramidespelen; en/of
• (i) waarmee het plegen van illegale activiteiten wordt bevorderd of gepleegd; en/of
• (j) waarbij kettingbrieven, junk-mail of spamming betrokken zijn; en/of
• (k) waarbij een foto of beeltenis is opgenomen van een andere persoon zonder diens toestemming; en/of
• (l) waarbij inbreuk wordt gemaakt op intellectuele eigendomsrechten van anderen; en/of
• (m) die in strijd zijn met enige wet, regeling, verordening, andere toepasselijke regelgeving of deze Algemene Voorwaarden.

5. Content van Derden

5.1 Het is mogelijk dat de Website applicaties, bestanden, gegevens en/of materialen en diensten van derden en/of links naar websites van derden bevat (“Content van Derden”) bijvoorbeeld door middel van een hyperlink, banner of button. De opname of aanwezigheid van Content van Derden op de Website impliceert niet dat PIF deze Content van Derden heeft goedgekeurd dan wel gecontroleerd. PIF is niet verantwoordelijk voor de inhoud en werkwijze van Content van derden of voor enig gebruik hiervan door gebruikers van de Website.

5.2 Voor producten of diensten die worden aangeboden door derden gelden de toepasselijke voorwaarden van die derden.

6. Dienstverlening

6.1 PIF reguleert de communicatie tussen Charities en Players, Gebruikers onderling en/of Gebruikers en de dienst van PIF niet inhoudelijk. PIF heeft dan ook geen of ten hoogste een zeer beperkte controle over de kwaliteit, veiligheid, rechtmatigheid, integriteit of juistheid van de (verschillende onderdelen van de) van de dienst van PIF.

<7>Privacy het gebruik van de Website is de Gebruiker gebonden aan de Privacy Verklaring. <8>Stopzetten en onderbrekingen

8.1 In aanvulling op de andere (rechts-)middelen die PIF ten dienst staan, is PIF BV gerechtigd om de activiteiten, verricht door de Gebruiker in verband met de Website te beperken, de account tijdelijk of blijvend stop te zetten en /of te verwijderen en/of verwijderd te houden, de bestanden, gegevens en/of materialen te verwijderen, de overige Gebruikers van de Website op de hoogte te stellen van de activiteiten, een waarschuwing te doen uitgaan en te weigeren om diensten aan de Gebruikers te verlenen, in het bijzonder maar niet daartoe beperkt, indien de Gebruiker:

• - handelt in strijd met de Algemene Voorwaarden en/of in strijd met de Bijzondere Bepalingen;
• - PIF BV en/of Stichting PIF niet in staat is om enige gegevens die de Gebruiker aan PIF BV en/of Stichting PIF verstrekt te verifiëren of te identificeren;
• - PIF BV van mening is dat de handelingen van de Gebruiker schade aan zichzelf of aan andere gebruikers of aan PIF kan toebrengen;
• - PIF BV van mening is dat de handelingen van de Gebruiker aansprakelijkheid voor zichzelf of voor andere gebruikers of voor PIF kan opleveren.

PIF is op geen enkele wijze aansprakelijk voor enige schade ten gevolge van handelen of /of nalaten waartoe PIF BV en/of Stichting PIF op grond van dit artikel gerechtigd is/zijn.

8.2 PIF BV is gerechtigd zonder voorafgaande bekendmaking de dienst (tijdelijk) buiten gebruik te stellen of het gebruik ervan te beperken dan wel de dienstverlening in het kader van PIF BV te beëindigen zonder daarvoor een reden te hoeven opgeven en zonder dat hierdoor enig recht op schadevergoeding jegens PIF ontstaat.

8.3 PIF garandeert niet dat de dienst van PIF BV te allen tijde en zonder onderbrekingen of storingen toegankelijk is.

9. Donaties

9.1 Gebruikers kunnen aan Stichting PIF geld doneren ten behoeve van een Project en/of een Nonprofit of aan een Nonprofit.

9.2 Na het bereiken van het Project Budget en onder de voorwaarden als genoemd in de Sponsor- en Plaatsingsovereenkomst, betaalt Stichting PIF de donaties, onder aftrek van transactiekosten, aan de Nonprofit voor het door haar geleide of ondersteunde Project.

9.3 PIF BV behoudt zich het recht voor het Project niet op de Website te plaatsen of van de Website te verwijderen en verwijderd te houden indien:

• (a) niet binnen zes maanden na plaatsing van het Project op de Website het Project Budget is bereikt; en/of
• (b) de Nonprofit handelt in strijd met de Algemene Voorwaarden; en/of
• (c) wanneer feiten of omstandigheden bekend zijn geworden met betrekking tot het Project en/of de Nonprofit, die, waren zij aan PIF bekend geweest ten tijde van het tekenen van de Sponsor- en Plaatsingsovereenkomst, aanleiding zouden kunnen zijn geweest de Sponsor- en Plaatsingsovereenkomst niet aan te gaan; en/of
• (d) de Nonprofit niet voldoet aan de in de Sponsor- en Plaatsingsovereenkomst omschreven verplichtingen met betrekking tot het aanleveren van visuele rapportages (video- of fotorapportage) over het Project.

9.4 PIF BV stelt de Nonprofit per e-mail van haar beslissing het Project niet op de Website te plaatsen of van de Website te verwijderen en verwijderd te houden op de hoogte met opgaaf van redenen.

9.5 Indien het Project door PIF BV van de Website wordt verwijderd en verwijderd wordt gehouden, heeft de Nonprofit geen recht op de door Stichting PIF voor het Project ontvangen gelden zonder dat zij gerechtigd is tot enige compensatie of schadevergoeding.

9.6 Bij verwijdering ingevolge artikel 9.3. zal, in het geval Stichting PIF nog geen gelden aan de Nonprofit heeft uitgekeerd, de Wallet van de Player(s) die voor het betreffende Project geld heeft/hebben overgemaakt aan Stichting PIF worden gecrediteerd met deze geschonken gelden teneinde deze Player(s) in de gelegenheid te stellen deze gelden aan een ander project op de Website ten goede te laten komen mits deze Player(s) een account had(den) bij de Website op het moment van de desbetreffende donatie.

9.7 Gebruikers en/of Players die ten behoeve van een Project hebben gedoneerd zonder dat zij een account hadden bij de Website op het moment van de desbetreffende donatie hebben, in geval van verwijdering van het Project van de Website, geen recht op (terug)betaling van het gedoneerde bedrag ten behoeve van dat Project. In dat geval zal Stichting PIF, te harer discretie, de gelden die zij ten behoeve van dat Project heeft ontvangen alloceren aan een Nonprofit die een project heeft op de Website.

9.8 Indien uitkering van (een deel van de ) gelden door Stichting PIF reeds heeft plaatsgevonden, zal creditering van de Wallet als bedoeld in artikel 9.6 niet plaatsvinden en zal Stichting PIF, te harer discretie, de nog in haar bezit zijnde gelden ten behoeve van dat Project alloceren aan een Nonprofit die een project heeft op de Website.

9.9 In het geval twee Gebruikers op hetzelfde moment het bedrag doneren dat nodig is om het budget van een Project te completeren, kan het voorkomen dat beide donaties worden verwerkt. Als de Gebruiker die het laatst doneerde een Player is, zal zijn/haar donatie worden teruggestort in zijn/haar Wallet. Indien de Gebruiker die het laatst doneerde geen Player is, heeft hij/zij geen recht op (terug)betaling van het gedoneerde bedrag ten behoeve van dat Project. In dat geval zal Stichting PIF, te harer discretie, de gelden die zij ten behoeve van dat Project heeft ontvangen alloceren aan een Nonprofit die een project heeft op de Website.

9.10 Op de rechtsverhouding(en) tussen Stichting PIF en de Gebruiker zijn de artikelen 175 tot en met 188, Boek 7 BW (Burgerlijk Wetboek) betreffende ‘schenking’ van overeenkomstige toepassing.9.11 Conform artikel 7:175 lid 2 BW geldt een door een Gebruiker aan de Stichting PIF gedane donatie als door de Stichting PIF aangenomen, wanneer Stichting PIF na van de donatie te hebben kennis genomen, deze donatie niet onverwijld heeft afgewezen.

9.12 De gestorte donaties kunnen niet worden teruggevorderd. Dit overeenkomstig artikel 46a t/m f van het Burgerlijk Wetboek 7, afdeling 9A: Overeenkomsten op afstand.

Uitbetaling van gelden gedoneerd aan een Nonprofit en/of aan Stichting PIF ten behoeve van een Nonprofit

9.13 Gelden gedoneerd door een Gebruiker aan een Nonprofit anders dan door allocatie van gelden in de Wallet van de desbetreffende Gebruiker aan die Nonprofit, zijn schenkingen aan de Nonprofit en worden door de Gebruiker rechtstreeks overgemaakt op de door de Nonprofit aan PIF BV kenbaar gemaakte bankrekening van de Nonprofit in Nederland.

9.14 Conform artikel 7:175 lid 2 BW geldt een door een Gebruiker aan de Nonprofit gedane donatie als door die Nonprofit aangenomen, wanneer de desbetreffende Nonprofit na van de donatie te hebben kennis genomen, deze donatie niet onverwijld heeft afgewezen.

9.15 De gestorte donaties kunnen niet worden teruggevorderd. Dit overeenkomstig artikel 46a t/m f van het Burgerlijk Wetboek 7, afdeling 9A: Overeenkomsten op afstand.

9.16 Gelden gedoneerd door een Gebruiker ten behoeve van een Nonprofit door allocatie van gelden in de Wallet van de desbetreffende Gebruiker aan die Nonprofit worden door Stichting PIF één keer per kwartaal overgemaakt op de door de Nonprofit aan PIF BV kenbaar gemaakte bankrekening van de Nonprofit in Nederland.

9.17 PIF BV behoudt zich het recht voor een Nonprofit niet op de Website te plaatsen of van de Website te verwijderen en verwijderd te houden indien:

• (a) de Nonprofit handelt in strijd met de Algemene Voorwaarden; en/of
• (b) wanneer feiten of omstandigheden bekend zijn geworden met betrekking tot de Nonprofit, die, waren zij aan PIF bekend geweest ten tijde van het aanmaken van de Nonprofitpagina voor PIF BV aanleiding zouden kunnen zijn geweest voor de Nonprofit geen Nonprofitpagina aan te maken;

9.18 PIF BV stelt de Nonprofit per e-mail van haar beslissing de Nonprofit niet op de Website te plaatsen of van de Website te verwijderen en verwijderd te houden op de hoogte met opgaaf van redenen.

9.19 Indien de Nonprofit door PIF BV van de Website wordt verwijderd en verwijderd wordt gehouden, heeft de Nonprofit geen recht op de door Stichting PIF voor de Nonprofit ontvangen gelden zonder dat de Nonprofit gerechtigd is tot enige compensatie of schadevergoeding.

9.10 Op de rechtsverhouding(en) tussen Stichting PIF en de Gebruiker zijn de artikelen 175 tot en met 188, Boek 7 BW (Burgerlijk Wetboek) betreffende ‘schenking’ van overeenkomstige toepassing.

9.11 Conform artikel 7:175 lid 2 BW geldt een door een Gebruiker aan de Stichting PIF gedane donatie als door de Stichting PIF aangenomen, wanneer Stichting PIF na van de donatie te hebben kennis genomen, deze donatie niet onverwijld heeft afgewezen.

10. Aansprakelijkheid

10.1 PIF BV noch Stichting PIF zijn op enige wijze verantwoordelijk en/of aansprakelijk voor de uitvoering, financiering, begroting van kosten, besteding van ten behoeve van Projecten en/of Charities gedoneerde gelden, monitoring, evaluatie en follow-up van Projecten en/of Charities.

10.2 Voor zover wettelijk toegestaan sluit PIF, waaronder in dit verband mede wordt verstaan de aan PIF gelieerde bedrijven, functionarissen en werknemers, hierbij iedere aansprakelijkheid uit voor welke schade dan ook, direct en/of indirect, op enige wijze ontstaan door en/of voortvloeiend uit het gebruik van de Website of een andere aan de Website gekoppelde site.

10.3 Onverminderd het voorafgaande zal PIF meer in het bijzonder in geen geval aansprakelijk zijn voor welke schade dan ook, die op enige wijze ontstaat door en/of voortvloeit uit:

• - handelingen door de Gebruiker verricht, die zouden zijn ingegeven door de op de Website geplaatste informatie; en/of
• - de onmogelijkheid de Website te gebruiken; en/of
• - het feit dat bepaalde informatie op de Website onjuist, onvolledig of niet actueel is; en/of
• - de manier waarop Charities, Players of andere Gebruikers gebruik maken van de door de PIF geleverde diensten en/of apparatuur en aanverwante voorzieningen. Met name zullen Charities, Players of andere Gebruikers PIF vrijwaren van aanspraken door derden welke betrekking hebben op de inhoud van door hen aangeleverde bestanden, gegevens en/of materialen die PIF op haar website beschikbaar stelt.

10.4 Indien PIF als gevolg van een aan haar toe te rekenen tekortkoming niettemin aansprakelijk is, zal de aansprakelijkheid beperkt zijn tot de directe zaakschade die in onmiddellijk verband staat met de tekortkoming. PIF is in ieder geval nimmer aansprakelijk voor gevolgschade, waaronder mede begrepen zuivere vermogensschade, gederfde omzet en winst, verlies van gegevens en immateriële schade, verband houdend met of voortvloeiend uit de diensten die PIF verricht en of het gebruik van de Website.

10.5 Voor zover PIF als gevolg van een haar toe te rekenen tekortkoming niettemin aansprakelijk is, zal ten aanzien van de Gebruiker deze aansprakelijkheid per gebeurtenis (waarbij een samenhangende reeks van gebeurtenissen als één gebeurtenis wordt beschouwd) zijn beperkt tot de in het lopende kalenderjaar daadwerkelijk door de Gebruiker aan Stichting PIF geschonken gelden.

10.6 Deze aansprakelijkheidsbeperking beoogt niet de aansprakelijkheid van PIF voor opzet en/of grove schuld van PIF uit te sluiten.

11. Overige bepalingen; toepasselijk recht

11.1 Onverminderd eventueel voor PIF bestaande wettelijke verplichtingen om de overeenkomst tussen PIF en de Gebruiker te bewaren, is PIF niet verplicht om een eventueel gearchiveerde overeenkomst voor hem/haar toegankelijk te houden.

11.2 Op deze Algemene Voorwaarden is Nederlands recht van toepassing. Alle eventueel uit deze overeenkomst voortvloeiende geschillen zullen bij uitsluiting van ieder ander worden voorgelegd aan de bevoegde rechter te Amsterdam.

BIJZONDERE BEPALINGEN PIF – CHARITY

1. Aanmelden Project en Projectselectie

1.1 Stichtingen opgericht naar Nederlands recht met een bankrekening in Nederland kunnen een Project aanmelden bij PIF BV door middel van het toesturen van een ingevuld Applicatieformulier zoals vermeld op de Website. Applicatieformulieren ingevuld door vergelijkbare entiteiten naar vreemd recht kunnen ook in overweging worden genomen.

1.2 De opgenomen posten in het Project Budget dienen betrekking te hebben op kosten die direct aan de uitvoering van een Project zijn verbonden.

1.3 PIF BV beslist of een Project op haar website wordt geplaatst en laat zich bij haar beslissing of een Project op de Website wordt geplaatst onder meer leiden door:

• (a) de mate waarin het project bijdraagt aan een positieve verandering voor mens, dier of aarde;
• (b) de mate waarin de in artikel 1.1. bedoelde stichting op dat moment en/of in het verleden aan haar verplichtingen uit hoofde van de Sponsor- en Plaatsingsovereenkomst en de Algemene Voorwaarden en Bijzondere bepalingen voldoet/heeft voldaan.
• (c) het aanbod van Projecten op de Website met het oog op een evenwichtige projectportefeuille.

2. Aanmelden als Nonprofit Member

2.1 Stichtingen opgericht naar Nederlands recht met een ANBI-status en een bankrekening in Nederland en een kunnen zich als Nonprofit Member aanmelden bij PIF BV door middel van het toesturen van een ingevuld aanvraagformulier (met als bijlagen een recent uittreksel KvK en kopie van de door de notaris verleden statuten) zoals vermeld op de Website. Aanvraagformulieren ingevuld door vergelijkbare entiteiten naar vreemd recht kunnen ook in overweging worden genomen.

2.3 PIF BV beslist of een Nonprofit als Nonprofit Member wordt geaccepteerd en laat zich bij haar beslissing leiden door

• a. de mate waarin de Nonprofit bijdraagt aan een positieve verandering voor mens, dier of aarde;
• b. de mate waarin de in artikel 2.1. bedoelde Nonprofit op dat moment en/of in het verleden aan haar verplichtingen uit hoofde van de Algemene Voorwaarden en Bijzondere bepalingen voldoet/heeft voldaan.

2.4 Op verzoek zal de Nonprofit de financiële verslaglegging van het vorig of lopende boekjaar overleggen aan PIF BV.

BIJZONDERE BEPALINGEN PIF – Player

1. Account

1.1 Een Gebruiker kan een eigen account aan te vragen op de wijze zoals beschreven op de Website om gebruik te maken van bepaalde diensten van PIF.

1.2 PIF BV kan naar eigen inzicht bepalen of zij al dan niet een account verstrekt.

1.3 Rechtspersonen met een winstoogmerk kunnen slechts Player worden en blijven en (derhalve) een profiel op de Website aanmaken en instandhouden na voorafgaande schriftelijke toestemming van PIF BV. Tenzij uitdrukkelijk anders overeengekomen eindigt deze toestemming op het moment dat de Website een aparte functionaliteit bevat die (mede) bedoeld is voor dergelijke rechtspersonen. PIF BV kan daarnaast deze toestemming op ieder door haar gewenst moment intrekken en aan voorwaarden onderwerpen.

1.4 De Player kan op elk gewenst moment zijn/haar account beëindigen op de wijze zoals beschreven op de Website. De Player heeft geen recht op (terug)betaling van enig tegoed in zijn/haar Wallet op het moment van beëindiging van zijn/haar account. Stichting PIF zal, te harer discretie, deze gelden overmaken aan een Nonprofit die een project heeft op de Website.

1.5 De Player staat er jegens PIF voor in dat de informatie die de Player aan PIF verstrekt, compleet, naar waarheid en juist is, waaronder de persoonsgegevens van de Player zoals de naam en het emailadres.

1.6 De Player stemt ermee in dat PIF BV de gegevens opslaat en gebruikt in verband met het beheer van de account.

1.7 Als de Player jonger is dan zestien (16) jaar moet hij/zij van haar/zijn ouders toestemming hebben voor het aanmaken van een account. Door de acceptatie van deze Algemene Voorwaarden garandeert de Player dat deze zestien (16) jaar of ouder is of toestemming heeft van haar/zijn ouders voor het aanmaken van een account.

1.8 De Player mag geen accounts aanmaken op naam van een andere persoon, tenzij die andere persoon hem/haar daarvoor schriftelijk toestemming heeft gegeven en deze schriftelijke toestemming op eerste verzoek van PIF BV door de Player aan PIF BV zal worden overhandigd.

1.9 Indien een Player bij het aanmaken van zijn/haar account een username heeft gekozen die voorkomt in de naam van een (latere) partner van PIF, zal de username van de desbetreffende Player worden gewijzigd in “Player[username]”.

1.10 De Player is zelf verantwoordelijk voor het geheimhouden van het wachtwoord van zijn/haar account voor anderen en zal anderen geen toegang verlenen tot de Website met behulp van de eigen account.

1.11 In de periode voorafgaand aan het moment dat de Player PIF op de hoogte stelt van enig ongeoorloofd gebruik is de Player aansprakelijk voor de gevolgen van het feit dat anderen de account van de Player gebruiken, met of zonder toestemming of wetenschap van de Player.

Privacy Verklaring en Play it Forward B.V.

Play It Forward B.V. (hierna 'PIF') neemt uw privacy zeer serieus. PIF houdt zich aan de volgende principes om uw privacy te beschermen:

• (i) PIF zal zonder uw uitdrukkelijk toestemming uw (persoons-)gegevens nooit verstrekken aan derden, ook niet aan de partnerorganisatie wier projecten u steunt; en
• (ii) PIF zal uw (persoons-)gegevens niet verhuren of verkopen aan derden voor marketingdoeleinden; en
• (iii) alle door u verstrekte (persoons-)gegevens zullen worden beveiligd volgens industriestandaard protocollen en technologie

u alstublieft in acht, dat door het bezoeken van of registreren op www.pifworld.com (de 'Website') u akkoord gaat met onderstaande voorwaarden. Daarom raden wij u ten zeerste aan om deze Privacy Verklaring zorgvuldig door te nemen zodat u op de hoogte bent hoe uw (persoons-)gegevens zullen worden behandeld bij gebruik van de Website.

Wie is Play It Forward B.V.?

PIF is de maker van Pifworld.

PIF, opgericht in 2007, is een besloten vennootschap met beperkte aansprakelijkheid opgericht naar Nederlands recht, gevestigd te Amsterdam, Nederland. PIF houdt kantoor aan de Tolstraat 129 - A3.16, Amsterdam en is geregistreerd bij de Nederlandse Kamer van Koophandel onder nummer 34291870. De wijze van opslaan en het gebruik van uw persoonsgegevens zijn aangemeld bij het College Bescherming Persoonsgegevens onder nummer m1394590. PIF is bereikbaar via

Welke (persoons)informatie wordt door PIF verzameld en verwerkt?

PIF verzamelt uw (persoons-)gegevens op de volgende wijze:

(i) informatie die PIF verzamelt als u de Website bezoekt

PIF verzamelt informatie over uw Internet Protocol (IP) adres, de URL's van sites waar u vandaan surft en heen surft, uw browser type en uw ISP. Een IP adres is een nummer dat automatisch wordt toegewezen aan uw computer als u gebruik maakt van het internet en dat het mogelijk maakt om uw computer te identificeren.

Deze informatie helpt PIF bij het toezien op patronen in het siteverkeer en zodoende de service te verbeteren of om te bepalen vanaf welke computers de Website wordt bezocht in het geval van potentieel misbruik of hack pogingen. Deze data kunnen ook worden gebruikt om achter de identiteit te komen van potentiële stalkers indien PIF en/of de Website wordt lastig gevallen of in het geval van nep accounts.

De koppeling tussen uw IP adres en uw (persoons-)gegevens zal niet worden gedeeld met derden zonder uw toestemming tenzij hiertoe een wettelijke plicht bestaat.

Zoals vele andere websites, maakt PIF gebruik van cookies en weblog bestanden om het gebruik van de Website bij te houden en u daardoor te herkennen, de Website aan uw wensen aan te passen en voor advertentiedoeleinden. Een cookie bestaat uit een kleine hoeveelheid data, waaronder een anonieme unieke identificatiecode, die wordt bewaard op uw harde schijf of in uw computergeheugen.

De meeste internet browsers accepteren cookies automatisch. Door uw browser instellingen aan te passen kan u uw browser zo instellen dat het automatisch accepteren van cookies wordt gestopt of dat u wordt ingelicht tijdens het bezoeken van een website alvorens een cookie wordt geaccepteerd. Houdt u er wel rekening mee dat sommige delen van de Website minder goed functioneren indien cookies worden geweigerd. Cookies zijn niet schadelijk voor uw computer of bestanden. PIF maakt geen gebruik van cookies voor het verzamelen van (persoons-)gegevens.

(ii) informatie die PIF verzamelt bij uw registratie als Player of via uw profiel pagina

Voordat u een Player wordt, moet u eerst een account aanmaken op Pifworld. Wanneer u een account aanmaakt, wordt u gevraagd de volgende informatie te verstrekken: email adres, gebruikersnaam en wachtwoord. U kan de verstrekte (persoons-)informatie altijd wijzigen, met uitzondering van uw gebruikersnaam.

Wanneer u geregistreerd bent als Player, kunt u extra informatie verschaffen op uw persoonlijk profiel of bij het doen van een donatie. Het verschaffen van extra informatie buiten de voor registratie vereiste informatie is geheel facultatief. U kunt bijvoorbeeld op uw profiel pagina aangeven wat uw interesses zijn, welke landen uw interesse hebben etcetera. Dit kan nuttig zijn voor andere Players die uw profiel bekijken, maar ook voor PIF omdat wij op deze manier Pifworld beter kunnen aanpassen aan uw wensen.

Alle door u verstrekte niet persoonlijk identificeerbare informatie bij registratie als Player of op uw profielpagina of bij het doen van een donatie kan op dezelfde wijze en in dezelfde mate worden gebruikt als is toegestaan bij andere niet persoonlijk identificeerbare informatie, inclusief gebruik voor advertentiedoeleinden via de Website.

(iii) de informatie die PIF verzamelt wanneer u doneert zonder te registreren als Player

Wanneer u doneert zonder dat u zich registreert als Player, wordt u gevraagd de volgende informatie te verstrekken: uw voor- en achternaam, woonplaats, land en email adres. U kunt extra informatie verschaffen bij het doen van een donatie (u kunt namelijk een opmerking bij uw donatie plaatsen).

(iv) de informatie die PIF's payment service provider verzamelt wanneer u doneert of uw Wallet uploadt

Wanneer u doneert of uw Wallet op de Website upload, zal naar uw betaalgegevens (zoals credit- of debitcard gegevens) worden gevraagd. Deze betaalgegevens worden niet verzameld door PIF, maar door haar payment service provider RBS WorldPay die uw donatie zal verwerken. Hierdoor worden uw credit-of debitcard gegevens niet bekend bij PIF.

Voor welke doeleinden gebruikt PIF uw (persoons-)gegevens?

PIF zal uw persoonlijke gegevens gebruiken voor de specifieke doeleinden zoals boven uiteengezet en voor de volgende algemene doeleinden:

• (i) om met u te communiceren over Pifworld en om informatie toe te zenden over Pifworld's services, zoals Pifworld updates;
• (ii) om Pifworld aan te passen aan uw wensen en behoeftes;
• (iii) ter beveiliging; en
• (iv) voor het formuleren van anoniem verkregen statistische data. PIF zal automatisch gegenereerde data, inclusief uw IP-adres, leveren aan derden om gebruikersstatistieken en web analyses uit te laten voeren in opdracht van PIF.

Communicatie van PIF

PIF zal met u communiceren via email en via berichten die op de Website worden geplaatst.

Als Player kunt u van PIF een periodieke update ontvangen over Pifworld. Als donateur zonder dat u zich als Player registreert, ontvangt u deze update niet en zult u alleen emails van PIF ontvangen indien u dit heeft aangegeven. Iedere email aan donateurs die zich niet hebben geregistreerd bevat de mogelijkheid aan te geven dat deze niet meer gewenst zijn. Als Player kunt u op uw profielpagina aangeven wanneer u deze periodiek update niet (meer) wenst te ontvangen.

PIF zal incidenteel algemene emails versturen over Pifworld en berichtgevingen over belangrijke veranderingen betreffende de geleverde service.

Communicatie van andere Players binnen Pifworld

Wanneer u anderen wilt uitnodigen om Friends te worden binnen Pifworld, kunt u gebruik maken van de services van Pifworld om een uitnodiging te sturen (als ze al Player zijn) of door middel van het invoeren van hun namen en email adressen. Deze informatie zal door PIF worden gebruikt om de uitnodiging te versturen, die ook een persoonlijke door uw geschreven boodschap kan bevatten. De door uw verschafte namen en email adressen zullen alleen worden gebruikt om uw uitnodiging en herinneringen te versturen. Wanneer u het email adres van een vriend doorgeeft aan PIF om een webadres door te sturen dan zal PIF deze alleen hiervoor gebruiken.

Als Player kunt u emails ontvangen van andere Players om Friends te worden. Ook is het mogelijk dat u via de email een verzoek ontvangt van een bevriende Player om een donatie te geven aan het project dat hij/zij steunt. Ook kunt u prive-berichten ontvangen van Friends.

Blogs

U dient zich ervan bewust te zijn dat wanneer u een blog schrijft op Pifworld alle door u verstrekte (persoons-)gegevens die u op uw blog zichtbaar maakt, kunnen worden gelezen, verzameld of gebruikt door derden en zodoende kunnen worden gebruikt om ongewenste berichten aan u te versturen. PIF is niet verantwoordelijk voor de (persoons-)gegevens die u zelf op uw blog plaatst.

Welke informatie is zichtbaar voor anderen?

Bezoekers van de Website kunnen, indien u geregistreerd bent als Player, uw gebruikersnaam, en land zien, alsmede uw volledige profiel (indien u extra informatie heeft geplaatst op uw profiel of bij een donatie zal dit ook zichtbaar zijn). Indien u heeft gedoneerd zonder dat u zich als Player heeft geregistreerd, kunnen bezoekers uw naam, stad en land, de hoogte van uw donatie en, indien door u geplaatst, uw opmerking bij een donatie.

Het kan zijn dat uw profiel wordt geregistreerd in zoekmachines. Ook kunnen andere Players en bezoekers van de Website een lijst zien van uw vrienden, de projecten waaraan u gedoneerd heeft en het (totaal) bedrag dat u heeft gedoneerd alsmede een eventueel bij de donatie geplaatste opmerking. Als u niet wilt dat het door u gedoneerde bedrag zichtbaar is voor derden, kunt u als Player dit aangeven in uw profiel en dan zal dit niet meer worden getoond op uw profielpagina of op de projectpagina van het project waaraan u heeft gedoneerd. Bij donateurs die niet geregistreerd zijn is het bedrag dat per donatie is overgemaakt altijd zichtbaar op de projectpagina.

Delen en openbaarmaking van informatie

Om haar diensten naar behoren te leveren zal PIF gebruik maken van betrouwbare externe partijen om bepaalde functies en diensten uit te voeren, waaronder, doch niet beperkt tot, hosting en onderhoud van de Website, database opslag, toezicht en betalingsdiensten. PIF zal uw (persoons-)gegevens delen met deze partijen, maar alleen voor zover dat nodig is om deze functies en diensten uit te voeren en te leveren.

PIF zal uw (persoons-)gegevens en andere informatie ook kunnen doorgeven aan derden in verband met een fusie, overname, reorganisatie, verkoop van activa of in het geval van een faillissement. Elke derde partij aan wie PIF zijn bezittingen zal verkopen zal het recht hebben om deze (persoons-)gegevens en andere informatie te gebruiken.

Veiligheidsmaatregelen om uw informatie te beschermen

Om uw persoonlijke gegevens te beschermen zal de toegang tot deze gegevens worden beschermd door middel van een wachtwoord. Gegevens waarop dit van toepassing is (zoals uw creditcard informatie) zullen worden beschermd door middel van een codering met behulp van het Secure Sockets Layer protocol. Het is uw eigen verantwoordelijkheid om de veiligheid van uw login gegevens te beschermen. Neemt u alstublieft in acht, dat emails met andere Players op Pifworld niet worden gecodeerd en daarom raden wij u sterk aan om geen vertrouwelijke informatie te delen via deze middelen.

Kinderen en Pifworld

In principe kan iedereen zich aansluiten bij en een account aanmaken op Pifworld. Het is echter belangrijk om te weten dat er speciale wettelijke regels van toepassing zijn op personen beneden de zestien (16). Als je nog geen zestien (16) bent dan ben je verplicht om toestemming te vragen aan je ouders of voogd voordat je een account aanmaakt op de Website. Door het aanvaarden van deze Privacy Verklaring garandeer je dat je ten minste zestien (16) jaar oud bent of dat je toestemming hebt van je ouders/voogd om een account aan te maken.

Doorgifte naar landen buiten de EU

Om technische en operationele redenen kan het nodig zijn dat uw (persoons-)gegevens worden doorgegeven (naar servers van) aan PIF gelieerde ondernemingen en/of adverteerders in de Verenigde Staten of andere landen buiten Europa, waar de regelgeving op het gebied van de privacybescherming mogelijk niet eenzelfde bescherming biedt als in de Europese Unie. Hierbij stemt u, voorzover nodig, er mee in dat uw (persoons-)gegevens naar de Verenigde Staten of andere landen buiten Europa kunnen worden doorgegeven.

Controle en verbetering van uw eigen gegevens.

Via uw eigen profiel kunt u altijd uw (persoonlijke) gegevens raadplegen en zo nodig veranderen of verwijderen, behalve die gegevens die verplicht zijn voor registratie.

U kan uw account opheffen in uw profiel. Als u uw Pifworld account opheft, dan zal PIF uw naam en andere (persoons-)gegevens verwijderen uit haar publiekelijk toegankelijke gegevens. Het kan voorkomen dat PIF bepaalde door u verschafte gegevens bewaren om fraude en toekomstig misbruik te voorkomen, of voor legitieme zakelijke doeleinden, zoals analyses van verzamelde niet persoonlijk identificeerbare gegevens, account herstel, of wanneer de wet dit vereist. Alle bewaarde gegevens zullen zijn onderworpen aan de voorwaarden van PIF's Privacy Verklaring zoals van kracht op het moment van uw aanvraag.

De Website bevat links naar andere websites zoals de websites van partnerorganisaties die de projecten uitvoeren die u steunt. PIF heeft geen zeggenschap over de websites van derden waarnaar wordt gelinkt Deze andere websites hebben hun eigen regels met betrekking tot het plaatsen van cookies of bestanden op uw computer, het verzamelen van data of het gebruik en verspreiden van uw persoonlijke gegevens. PIF raadt u ten zeerste aan om de privacy verklaringen van desbetreffende websites te bekijken. Deze Privacy Verklaring is alleen van toepassing op (persoonlijke) informatie die is verkregen via de Website. PIF aanvaardt geen enkele verantwoordelijkheid of aansprakelijkheid voor (de werking en/of inhoud van) de websites van derden.

Naleving van de wet en rechtshandhaving

Hoewel onwaarschijnlijk, kan het voorkomen dat PIF wettelijk is genoodzaakt om (persoons-)gegevens te verstrekken aan bevoegde instanties. PIF behoudt zich het recht voor om, naar eigen inzicht en discretie, alle informatie over u te verstrekken aan de overheid, gerechtelijke functionarissen of private partijen om te reageren op claims, juridische procedures (inclusief dagvaardingen), ter bescherming van het eigendom en de rechten van PIF of een derde partij, de algemene of persoonlijke veiligheid, ter voorkoming van illegale, onethische of juridisch uit te voeren activiteiten, of om te voldoen aan een wettelijke verplichting.

Als u niet tevreden bent met enig aspect van deze Privacy Verklaring staakt u alstublieft het gebruik van de Website en PIF's diensten. In de toekomst kan deze Privacy Verklaring worden aangepast.
